USCIS - Declaration of Intent (Wrong name & childs bday)

USCIS - Declaration of Intent (Wrong name & childs bday)

Hello,

Thank you in advance for taking the time to read this and respond.

I have my appointment w/ the NYC Italian Consulate in 20 days (YAY!).

I am reviewing all of my documents, and everything seems to be in order except (heart attack) ... my GGF USCIS Declaration of Intent has his name as Joseph instead of Giuseppe. And worse, under his children he has his son's (my GF) name as Frank and the birthday Jan 02, 1904 when all of my documents have my GF birthday as Jan 29th 1905.

My GGF never naturalized, the Declaration of Intent has a big notice of denied on it, and my GGF returned to Italy. Which I have his death certificate. I have 4 copies of a certified letter of "non-existance".

What would you do? Should I not present this letter/Declaration of Intent? Can I get this changed in 19 days? Can I place an avidavitt on it.

I doubt you can get the Declaration of Intent amended in any way.

Personally, I see no reason t present it at all. It proves nothing (he could have resubmitted at a later date) and you have the No Records Found letters...

More importantly, if he returned to Italy and remained there, you may want to see if you can get something from his comune indicating that he was an Italian citizen at the time of his death; that would settle the question beyond doubt. Possibly a Certificato di Cittadinanza, but I am not sure if these can be issued for deceased persons.

Thank you - do you have an idea of how I can go about getting "a Certificato di Cittadinanza"? I am unsure of the document itself, so I am unsure of what exactly to ask for, and to who.

A "Certificato di Cittadinanza Italiana" is a certificate attesting to the person's citizenship. I believe you can request one in the same way that you requested his birth certificate; just doctor up your request letter a little.
