Citizenship through marriage valid after spouse's death

Over 25 million Italians have emigrated between 1861 and 1960 with a migration boom between 1871 and 1915 when over 13,5 million emigrants left the country for European and overseas destinations.

Citizenship through marriage valid after spouse's death

Postby aulus » 27 Feb 2011, 23:12

So if my father had Italian citizenship passed on through his father (who was an Italian citizen at the time of birth), and my mother married him before 1983, but my father is now deceased, does that mean my mother is still entitled to Italian citizenship or not?

My understanding: yes.

Your mother became an Italian citizen at the moment she married. The fact that she didn't realize it is no different than the fact that you didn't realize you were born with Italian citizenship.

From what I have read, the one thing that could work against your mother is if your father died before April 27, 1983. However, I am not entirely clear on that point.

Were your parents still married at the time of your father's death? It might make a difference if they were divorced before he died.

Good point. Specifically, I believe they must have still been married (and thus, both living) on April 27, 1983.

Yes, they were married before 1983, never got divorced, and my father passed away after 1983.
