Italian citizenship from unwed mother?

Italian citizenship from unwed mother?

Hi!

I was hoping someone could help me with my question as I can’t find an answer online. My question is:

Does an Italian citizen mother who IS NOT married to the non Italian father transmit her citizenship onto her child automatically at birth if the child was born after 1948 (born in 1989) and born abroad in a country which gives the child citizenship at birth for being born in that country (Jure solis)?

Would a complete birth certificate be enough to prove MATERNITY even though the parents were not married (only mother is Italian) and therefore prove Italian citizenship of the child?

It would transmit to her children as far as I know, but it would not go onto her boyfriend. I would still make sure by emailing your nearest Consol.

Yes, citizenship was passed from the mother to the child.

Consulates do ask for marriage certificates and can be quite insistent about it, but marriage is not necessary to transmit citizenship.

It becomes easier if the mother is still living and can provide the proper documentation to the consulate herself.

Thank you, I told my cousin that his birth certificate should be enough to prove maternity shouldn't it?

That should do it. And he will, of course, have to prove his mother was still an Italian citizen when he was born.
