G-1041 Request and "Certification of Nonexistence"

G-1041 Request and "Certification of Nonexistence"

Hi Everyone,

I recently sent a G-1041 request to USCIS. I was informed that I needed to submit this form as part of my documentation for dual citizenship. However, subsequent to my request, I noticed the following on this website:

“Please note that the USCIS Genealogy Program does not process requests for a Certification of Nonexistence of a Record of Naturalization. In order to obtain a Certification of Nonexistence of a Record of Naturalization, you must forward a written request to the USCIS Records Services Branch for an agency decision to issue a Certification of Non-existence of a Record of Naturalization. There are no fees for this service. But it is important that all such requests be in writing and contain information to specifically identify the immigrant. . . . Requests for this service must be forwarded in writing to:

Steve,
Forget about the G-1041 and send a written request to the address you have. That is what I did and recieved my letter in about 6 weeks.

When you send your request, mention that line 4 must read " That the person listed did not become a citizen of the United States". It is very important. The consulate will not accept it without that specific verbage.

In regards to the NARA request, It is required and can be obtained by writing a request or in person if that is possible.

Hi Drew,

Are you certain I don't need the G-1041? Is there a form USCIS uses that has a line 4? Also, are your certain that the USCIS would commit to verbiage that "the person listed did not become a citizen of the United States." I would think that they would only would commit to that there is no record that shows that the person or became a citizen of the United States or similar verbiage such as the research shows no record.... Moreover, as far as the NARA request, at what address should I write for confirmation of "No Record?" As far as I know, there is no NARA office in San Diego to make my request in person, and the national NARA website is not very helpful who to write.

Hi Steve,

The NARA has regional offices. You will have to find the office that covers the area your ancestor lived. For example, my grandfather lived in Brooklyn so I went to the Northeast regional office. Where did your ancestor live?

In regards to the USCIS, the following is the letter I sent with great results.
Fill in your info and send it off. It will only cost you postage, you have nothing to lose.

Greetings Drew,

My grandfather lived only in San Diego as far as I know. The NARA Pacific Southwest office is in Laguna Niguel, CA. Should I write that office using the sample letter you provided herein.

Steve,

Use this letter for your USCIS request.
If you have a free day, I would suggest taking a drive up to their office and request a record search in person. If they find nothing, they will give you a letter that day. It's also a nice drive. :)

Hi Drew,

First, thank you very much for the form letter to the USCIS and all your help.

I found out that the Regional NARA office for San Diego is now in Riverside, CA. Another issue is that my grandfather original destination was Chicago, IL. Does this mean I also have to request a NARA search from the Chicago Regional office too. Please review the form letter I plan to send to the NARA office and let me know if there is anything I need to add or delete.

Steve,
I am very happy to be able to provide any help I can. The members in this forum have been extremely helpful to me and I would not be as prepared as i am for my appointment.

The letter looks great. The only thing I would amend is you want a full naturalization search. You should find out what the fee is for the search and send it with the request. A request to the Chicago office is not a bad idea. I also suggest that you request from the NARA a Certified copy of the 1930 census. Some Consulates require it as proof of no naturalization. If your grandmother is Theresa, than the census I found has him listed as an alien, which will help you prove your case.

The letter you will recieve from the NARA will not be certified. It will be a standard letter stating that their search ended with no records found. That is all you will need from them. The Census however, will be certified with a seal and ribbon.

Drew and Forum Members,

I went to the NARA office in Riverside, CA and they fulfilled my request. In the letter, I received the Archives Technician, she wrote the following:

"I am writing in response to your request on January 31, 2011 regarding a naturalization search for Dominick Musacco. Using your information I searched our naturalization index for the following court:

Records of the Superior Court, San Diego County.

I found no index reference to Dominick Musacco."


Do you think most consulates would consider this acceptable, or is more required?

They were very helpful at the NARA office, and I did get a certified copy of the 1930 Census. It cost $15.00 plus. There are some discrepancies in my grandmother's birthday (she indicated in several documents that she was born in 1878, but her birth certificate from Italy states she was born in 1876. I also got an uncertified copy of her petition of naturalization, which listed her children as does the 1930 Census. If I need to deal with the discrepancy of her birth date, I can request birth records for my grandparent's four children who were born in Italy. I don't know if this will become necessary, but I do have a plan if it is necessary. In the petition, she indicated she married my grandfather on October 31, 1898 while their marriage certificate from Italy indicated that they were married on October 31, 1897. This probably is no big deal.

The Archives Specialist at the NARA office also helped me find the manifest for the arrival of my grandmother into the United States.

Steve, That is the letter you need from the NARA. Good work.

If your grandmother is not in the direct line, leave the petition at home.

The census records are full of errors and you can have the NARA Tech you spoke with today write you a letter stating that they cannot be corrected. You only need the census to show that your grandfather was listed as an alien in 1930.
