Post by marymary52 » 10 May 2014, 04:11

My Grandmother and Grandfather both were born in Italy on my father side.
On my mothers side my Grandmother was born in the U.S ( from Italy parents) and my Grandfather was born in Sicily. Margaret

Basically, the new, post-WWII, Italian constitution which went into effect January 1, 1948 granted significant new rights to women. Prior to the new constitution, Italian citizenship was passed only through the father; among the changes is the passing of citizenship rights by the mother to all children born on or after January 1, 1948.

This limitation has been successfully challenged in Italian courts a number of times; however each case must be tried separately as Italy courts do not follow precedent decisions as US courts do. At least one Italian attorney, Luigi Paiano, seems to be making a living on these cases. Google him.
