1948 legal case but GGF different first name

Im trying to beat the 1948 rule and obtain dual citizenship USA and Italy.

My GGF is named Sabato on documents in Italy but when he was in USA he used the name Salvatore on documents.

Do you believe I might have a problem with the court in Italy when I file my 1948 lawsuit?

Here is a document that you may already have, but may help with clarification of given name.

This is a US Passport Application for Salvatore dated 11 October 1904. The passport was issued at the US Consulate in Naples, Italy. There is identifying information regarding Salvatore's place and date of birth, and his wife's name.
It might also help to find his naturalization papers, since the above passport indicates that he is naturalized.

His WWI registration also indicates that he was naturalized.

If this is your Salvatore Izzo, then he was naturalized in April 1903.
