I had done a genealogy request for a grandparents c-file from the USCIS genealogy program.
After waiting some months I received a letter denying my request because of privacy laws.
Now, the birthdate of my grandparent was 1883 in another country. Clearly over 100 years ago. I had enclosed a copy of his immigration papers including the naturalization certificate, death certificate, proof of who I was.
I appealed the decision but was denied because the appeal was received by them after the 60-day appeal period. I was told I could seek judicial review according to some act they sited.
I am still wondering why it was denied. Maybe someone could read the dates????????
I have just filled out the form again and am paying an additional $35 to see if I can obtain his record again.

I don't think I have ever heard of this before.
On this page, it says, "If your ancestor’s date of birth is less than 100 years ago or if you supplied an estimated date of birth, you will see a page notifying you of the required proof of death..."
I wonder - did you give an exact birthdate, or an estimated date? If estimated, were you prompted to upload a scanned copy of his death certificate (as the paragraph above goes on to say)?

I was not asked anything. Only when I received the denial did I send more documentation. Again, denied because of untimely receipt of documents.
No uploading requests at all. I am going to the website and see if any requests are made just for a test. Will let you know the outcome.

Dear Lilbees you were denied the second time and everytime hereafter because you did not full comply with the rules,regulation or procedures somewhere along the line and caused a defect (adminstrative land mine). This defect will not go way until you either correct the defect or get someone to tell you what you did wrong and what should you do to make things whole.
I would call them and ask where you went wrong and how you can correct the defect. As a last resort go to your congressman and tell him your a consituent and need a favor. This is what I would do and the steps I would take. =Peter=

Good Grief!!! How can you have a defect when filling in a form? Name, date of birth, death, etc. These are facts not guesses. Privacy Laws? As I said before, the man was born in 1883, not 1993. I do believe they read it wrong. (I kept a copy of what I sent)
I have now filled out another request which I will send by mail and not online with all the documentation attached. I don't think they will argue about that. I even have a better copy of his immigration papers than what they sent which I will also attach.
My problem with my grandfather is he came to this country under another name and changed it several years after arriving and before he filed for naturalization. I need the name to continue the quest for his birth record. ( I know the town and country he was born in). All who knew him under his real name are deceased. Also cannot get his marriage record since he married under that name. (my grandmother had also changed her name just prior to marriage). We will see if there is any more in the files. I hope.

I hope this is separate and apart from the original so that your starting all over. If they tie this into your "other" submission it may be rejected. Cross your fingers and turn the staue of Saint Anthony upside down. Keep us posted. =Peter=
