1948 Case with Luigi Paiano
Re: 1948 Case with Luigi Paiano
Dojo, your sentenza has already been published. Ask Luigi via e-mail to check on it and send it to you.
Re: 1948 Case with Luigi Paiano
Luigi contacted me yesterday, and has informed me that I have been awarded Italian citizenship! There were a couple typos in the decision that have to be corrected, but now starts the 7 and a half month appeal period to lapse.
Re: 1948 Case with Luigi Paiano
Hello everyone. I’ve posted this on another forum but I think it might be useful here as well. I would like to share my experience with attorney Luigi Piano in a 1948 case. Thanks to him, I can proudly say I am an Italian citizen.
My lineage is GGM>GM>M>Me. My great grandmother was an Italian citizen. She got married in 1931 to a Swiss citizen, automatically (and involuntarily) losing her Italian citizenship, and thus ruling out the possibility for my grandmother (who was born in 1934) and everyone that came after her to obtain the Italian citizenship through the consulate.
I decided to contact Mr. Paiano to get an opinion on my case. I sent him all the documents I had gathered (he also helped me get some documents from Italy) and he told me that the trial could be done, so we decided to hire him and go for it. There were 10 of us that participated in the trial including myself. Fortunately the process went smoothly and Mr. Paiano always kept us updated through every single step of it. The whole process took about two years. Last year the decision granting the Italian citizenship to everyone that participated in the trial arrived.
Here is a timeline of the whole process:
04/07/2014 Sent all documents and made first payment to Mr. Paiano
29/09/2014 Case filed
30/10/2014 Court date set
26/05/2015 First hearing, no second hearing needed
03/07/2015 Decision granting Italian citizenship arrived
06/06/2016 Documents registered at the comune
I know it’s not easy to make such an important investment with someone you haven’t met in person, but I can say that from the first time I spoke to him, he inspired a lot of trust in me. Reading other people’s testimonies also helped me make the decision to hire him, and I’m glad I did.
My family and I are very grateful to Mr. Paiano. If you are in a similar situation or have any doubts about any part of the process don’t hesitate to contact him. Also I would be more than happy to answer any questions you might have about my experience.
P.S. Congratulations to everyone that has won the trial and to those who are in the process or are thinking of starting it rest assured, if Mr. Paiano says it can be done, trust him, you will win as hundreds of us have.

Stefano, congrats!
Do you know if the process would be longer getting citizenship when other family members were added to your lawsuit? 1 family member is trying to get it ASAP. We have about 5-10 others that would be a quick add. We don't want to drag them down but it would be a savings to do all at once.

@lvelt I do not believe the process would be longer if you add more people. It should all be the same amount of time I would assume. But your best bet would be to contact your attorney for more accurate information. I would recommend Luigi, as I just won my case with him.

Re: 1948 Case with Luigi Paiano
Hi there everyone,
Does anybody here know........ once your documents are registered at the commune what the next step is? obviously getting your passport, but Im not sure of the process. From what I have read, you have to register at the ANAGRAFE or something like that and also get a document that proves your cittadinanza is real. Then make an appointment at the Embassy.
Has anybody here gone through that process all ready that can help clarify my doubts?
Mauro

The registration of your documents in your Comune (I hate it when I read the word "commune" in forums) allows you to request an italian birth certificate (atto di nascità) which you must deliver to your Consulate in order to be registered in the AIRE (Anagrafe degli Italiani Al Estero) and be able to request your Italian Passport and Carta d'Identità.

Hi Everyone,
As of tomorrow, 27 days to our trial (Sept 27). I'm a little nervous, there were so many issue to overcome in our documentation. Does anyone know if a case has ever been lost yet?

Re: 1948 Case with Luigi Paiano
Hi, I answered my own question, Luigi's site still says 100% wins.
So I do have a few questions:
After the win, the appeals waiting period is about 7 months but much less for many people right?
Once that period is over, does Luigi or the court send the information to the comune to register us?
Once the comune is done, does Luigi get our Italian birth certificates from them and send them to us or do we need to request them ourselves?
I think I recall Luigi saying he sends documentation to us, I'm thinking these are the birth certificates. Then we take just these to the consulate to register there and request our passports, sound right?
How long do we wait for the passports?
Thank you!

Re: 1948 Case with Luigi Paiano
Hi Queue.
Let's see:
Appeals waiting period is six months. After that Luigi requests the copies from the court and that takes about 3 weeks to a month.
Before that period is over, Luigi talks to your Comune (which Comune is it? Northern ones tend to be much more helpful than Southern ones, from what I've seen) and they tell him whether they'll register your birth certificate on the spot.
After the Comune is done, they send the BCs over to Luigi, and he in turn sends them to you to take to the Consulate, where with those they'll register you in the AIRE and issue your passports.
Finally, the wait for the passports depends on your Consulate. I've read from people who say a week, others who have to wait three months. In my case I went directly to my Comune and my whole process took five days.
Who's your Giudice?
Best,
Manu.

Re: 1948 Case with Luigi Paiano
Hi Manu,
Il nostro giudice: PRATESI CECILIA
E il nostro comune: Pastorano in Caserta, Compania
Trying out a little Italian, but we've been holding back until we get the approval, we're all very nervous given the complications in our case.
Thank you for your responses, it was exactly what I was looking for!

Re: 1948 Case with Luigi Paiano
Do you know anything about this particular judge?
Re: 1948 Case with Luigi Paiano
Sorry for the late reply Q. No idea on the giudice but you can look for other cases she has handled in the ministry webpage.
