1948 Case with Luigi Paiano

Over 25 million Italians have emigrated between 1861 and 1960 with a migration boom between 1871 and 1915 when over 13,5 million emigrants left the country for European and overseas destinations.

My grandmother married my grandfather, a naturalized US citizen, before the Cable Act so she was naturalized by marriage. In reading the forum, it seems like that in and of itself does not cause a problem for a claim of citizenship. My question is whether USCIS will return "no records found" if she was "naturalized by marriage". Anyone have any experience with that?
I am assuming your grandmother was Italian and your grandfather was possibly Italian, but US naturalized. Anyway, I am not sure it matters because the 1948 case is predicated on the fact that women were not allowed to pass their Italian citizenship regardless of whether they were naturalized or not and this was a discriminatory law. For example, in my case, my mother born in 1922 in Italy, came to US as a baby, lived and went to school here, met my father a US citizen, married in 1945, naturalized in 1952. Meanwhile from 1945 to 1961 she had 8 kids. We were granted our citizenship last year for the entire age range because my mother wasn't able to pass citizenship so because of this discriminatory law, she was forced to make life decisions without this being a factor she could consider (unlike the men of that time). We didn't even need to show her naturalization documents.

- do naturalization papers (petition/oath etc) need to be translated? Also, are ALL of the marriage certificates necessary? (including mine?)

My line is my GGF > GM > F > Me
I used Luigi's translator and assume she also translated the one naturalization document we needed (which was my grandmother's only to prove her name change). Regarding marriage certificates, I needed all those marriage certificates that made the necessary connections so I needed my parents to show name changes and that important connection. I needed my own to show my husband's connection to me so he could get citizenship. We needed my sister's to show her connection to her son who was included in the case. Luigi will tell you exactly which ones you need. It's easy to get copies of marriage certificates and the apostilles. You will need yours if you are married and had a name change (if you're a woman) or if you want to include your spouse in the citizenship trial. I included as many people in my extended family as I possibly could, which ended up being 11 of us, to reduce the cost. I did all the work on it so I didn't pay :)

I am just starting a 1948 case with Luigi Paiano. As many of you, I have spent a significant amount of time reading, researching and obtaining all necessary documents. Luigi has been THE KEY to understand the legal process and has been an incredible patient and dedicated person. Luigi should be filling the pleadings in court sometime this month.

My case involves 3 countries: Italy, USA, Venezuela.

Basically, my bisnnono immigrated to Venezuela but for some unknown reason my nonna was born in the USA. ALL other family civil records are found in Venezuela. Hence, I had to produce multiple certificates of No Naturalization from USCIS, NARA, State and Local Courts to cover such possibility in the USA, and also only one Certificate of No Naturalization from Venezuela. Other than that, all facts are standard/ the same as most cases.

Our translator was Teresa Borlotti ( She is phenomenal ).

I will keep you all posted so as to the development of my case. - I hope this helps other members of the forum.

Emiro
Emiro, good luck! Luigi is so patient! He answered so many questions from me and my extended family for months before we decided to go for it. Also, I agree, Teresa was fantastic! Keep us posted!

They were glorified photocopies but were considered certified I guess because they came from the government. I had the originals, but they insist on certified copies and besides I didn't want to take the chance of the originals getting lost in the mail etc. Also, Luigi said I didn't need my mother's naturalization document and the only reason I needed my grandmother's was to show her name change on the back of her naturalization document. Pretty sure I got apostilles on my grandmother's document as well, everything I sent had an apostille, not sure why a previous poster was saying it wasn't needed.
Thanks so much for this. Do you remember if you had to bring any other paperwork, like a death certificate or anything?

Question for those who are currently using or have hired Luigi Paiano...generally how long would it take to receive a response to an email that you have sent him requiring some sort of answer or response to the content of the message? (i am not currently with Luigi but considering a 'change')

Thanks

Ciao a tutti!

My name is Mariano, and I'm so close to finish my case (GM - F - Me). I've started on November 2016, luckily there was no need for a second hearing and the court sentence should be published soon.

I decided to hire Luigi when I was studying in Europe because my dad was born before 1948, and it was impossible to request the German citizenship by my mother's side, because we don't really know where my grand grand parents were born... So, I decided to pursue for my Italian citizenship.. in fact, I feel much closer to italians than spanish or germans... I shared all my childhood with my Italian grand mother, although my native language is spanish (I was born in Argentina).

Unfortunately I can't copy the dates and state of my case from the web portal of the "consultazione pubblica dei registri" because isn't working since a month due a maintenance (It is certainly a pretty long maintenance).

Btw, iIf someone need something I will gladly help.

So, update on my case. The first hearing was today, March 20 2018. Alas the judge has ordered a second hearing....for, get this, March 19, 2019.

Our case was filed in April 2017. So that was 11 months for the first hearing, now an entire year for the next. Reading through the forums this does not seem normal. I'm wondering if there are many more people going for citizenship now than in the past? Are the courts just slammed?

My judge was Albano Silvia by the way - I know I just read another poster who was recently assigned to that judge. Unfortunately this judge always asks for a second hearing :(

Feeling super down about it all at the moment. Oh well, for some it goes quickly but for others it's a waiting game!

Italian citizens who live in Italy (about 70 million of them) need to have more expedient access to the court system. You might feel super down about it but your 1948 cases are not a priority. I would think the new government elected on March 4 and about to be put in place might agree as the candidate who won ran on the slogan, "Italians First", of which you are not one until recognized.

Hi to all,

My case with Paiano and Bianchini is schedule for apr/10th now with the status RINVIATO PER PRECIZACIONI CONCLUSIONI, but I got the information this judge (Bianchini) is giving up the cases of citizenship. I made a research of all Bianchini's cases and I saw almost 14 cases schedule in the same day.

In case someone want the excel iformation I research, follow link to download:

Hey everyone,

Is anyone else having trouble with the Portale Servizi Telematici website? Every time I go on the website to view my case status I get a message that says:

Forbidden

You don't have permission to access /PST/it/pst_2_6_1.wp on this server.

It been happening for a few weeks now. Thanks!!

Yep. It’s under maintenance, seems like the IT department are upgrading or working on their infrastructure since a month and a half... unfortunately this is a very unusual outage.

Ciao!

I was able to access it just now. I had saved the app to my iPhone but could not get thru the way I usually do - by entering the case number and year. So I deleted it and tried again.
