Court order for birth records in New york?
Court order for birth records in New york?
I have been told that I will need a court order for birth certificates for my father and for death certificates for my grandmother. Does anyone have any information on where to start this process on my own? I would prefer not to go through a lawyer if possible.

This application for New York State vital records says:
"If the applicant is not the bride, groom or spouse, a judicial or other proper purpose must be documented. An example of a judicial or other proper purpose would be a marriage record needed by the applicant to claim a benefit.
• Documentation would consist of a copy of a court order or an official letter verifying that a copy of the requested marriage record is required from the applicant in order to process a claim."
I've read on another forum that no court order is necessary. Just fill out this affidavit, notarize it and and send it along with the application.

Can someone else verify that this is indeed the correct procedure? Thanks!

I just went through this process in NY to get my fathers certitifed birth certificate. I had to go to court and it took 9 months from start to end.

All of these events took place in NY (outside the city.) Is there a way get a court order that would apply to all of the certificates in one hearing? Have any of you found attorneys that have been helpful and reasonably priced? Any suggestions would be wonderful!

I went through the process of going through NY Supreme Court in Westchester County to get mt fathers birth certificate. I searched for a long time and I was not able to find an attorney that would get the birth certificate for me. I Had to fly to NY from CA to fill and file the necessary forms. I basically had to sue the the city of New Rochelle, NY City Clerk for them to release my fathers birth certitifcate. The state of New York has strict laws that states that the only person that can request the birth certificate has to be listed on the birth certificate. The whole process for me took 9 months. The approximate cost was $500 plus travel expenses for 1 trip to NY.
