Eligibility for Juris Sanguinis?

Over 25 million Italians have emigrated between 1861 and 1960 with a migration boom between 1871 and 1915 when over 13,5 million emigrants left the country for European and overseas destinations.

Eligibility for Juris Sanguinis?

Post by kferrari »

Hello, I'm hoping to have a couple of questions answered about the jure sanguinis process and eligibility.

My paternal great grandfather was born in Italy in 1886. I have tracked down his birth certificate already. He emigrated to Canada in 1907 and my paternal grandfather was born in Canada in 1909. My great grandfather was naturalized in Canada AFTER my grandfather was born, in 1910.

My father was born in the US in 1948 to Canadian parents, making my father a US citizen (and also eligible for Canadian citizenship). My father never renounced any citizenship, Italian or otherwise, and has also never claimed his Canadian citizenship. My father grew up in Canada until he was 7 and then moved to the US. I was born in the US in 1983.

My questions:
- We have not been able to track down my great grandmother's birth certificate (born in England) or her marriage certificate to my great grandfather. Is this an issue if she's not the direct line to Italy and my great grandfather's name is on my grandfather's birth certificate?
- Does my father being born in the US impact my ability to be eligible for jure sanguinis citizenship, even if he has never renounced Italian (or any other) citizenship?

Thank you in advance!
