1948 Case with Luigi Paiano

Over 25 million Italians have emigrated between 1861 and 1960 with a migration boom between 1871 and 1915 when over 13,5 million emigrants left the country for European and overseas destinations.

Hello,
I have just seen an update in my case and apparently the judge made final decision and then deposited his judgement in public on 7 August. But Luigi Paiano and everyone is out of office and I am wondering how I can check and find out the outcome of my case? :) does it mean I am Italian?

Hey,
No unfortunately no, I have to wait and find out if I am Italian or not when they are all back in office from holidays by end of this month. I will post an update as soon as I get news :(

There must be something about 7 August - perhaps it being the date when traditionally judges clear their desks before the holidays - because it was on 7 August 2018 I found myself in exactly the same position as Tomb and others in terms of waiting: Luigi confirmed on 26 August that the court had granted my application and we managed to cut the appeal period by intimating to the Government. Much turns on the approach of your comune after judgment is received but just to give an indication on timings I had my birth certificate in hand the week before Christmas 2018 and I received my passport in February 2019.

About a year ago the appeal period expired on my case and there was an error in one of the persons birthdays that needed to be amended since it was wrong. Luigi hasn’t given me any real expectation of timing for it to be corrected but ha anyone else had something like this happen? If so how long did it take to fix?

Alexr119, I am so sorry it has taken so long for you to get a response. By now it should not be too far down the road. Just going through the legal process and obtaining a positive ruling is such a huge endeavor. Was that issue spotted before or after the final order was recorded with your commune and Citizenship Certificates issued? - I ask because, I’m awaiting for my family’s hearings (2 hearings) in the first quarter of 2020. We are 28 individuals and I am afraid there may be typos on the final order. - I just wonder if anyone in this group received their Citizenship Certificates with misspellings of names due to the final order having them, and if they had just gone to get their passports with such mistakes while awaiting for the correction. - Have you?

I’m hoping it will be amended soon but it’s been nearly a year. And this amendment is in the court’s final decision, nothing to do with the comune, which may be why it’s taking so long. My advice to you is to read the decision very carefully once received and ask any questions prior to the expiration of the appeal so they can be amended as soon as possible

I have recently contacted Luigi Paino to help my husband gain his italian citizenship. Do you all feel it was a positive experiece with him? Is there anyone who can provide an estimate of the cost? I have been in touch with a couple of lawyers in the US who charge around $8000 for the service. I was surprised by the quote because my initial research indicated it would be more around $3000-$4000 on the high end. Any thoughts on whether Luigi might be less expensive?

Alexr119 how did it go with your amendment? I just got my positive sentence yesterday (hooray!!!!) and it lists my birthday as 22.4.977 instead of 22.4.1977. An obvious typo error. Is this what happened with you? It seems ridiculous to have to wait a year to fix a typo! I wrote Luigi about it but haven't heard back yet.

It took just over 50 weeks for the court to amend the error and Luigi now says it will take
"an average" of 6 months for the final decision. What did he say about the typo for you?

All, - just a quick update.

Our first hearing took place on 01/17 and the Judge did not issue a judgment because one of the documents lacked an Apostle. The judge set a new hearing for May 29th. Luigi sent me the document back, I got the Apostle, mailed it back to him and he has filed it with Court again. The hearing for our second group took place in February. So, now the judge will make the final decision for both cases in May 29th .

Luigi apologized for the oversight, but it was also my fault as I knew all documents have to have the Apostle. It’s OK though! - after waiting so many years for a hearing, waiting few more months is nothing.

Salute everyone!
