Need to amend my parents' marriage cert, but my dad isn't receptive

Post by JTSD20 »

Hi everyone,

I hope this snag I've run into doesn't mean that my case is dead. For some background, my dad is very nervous about identity theft and is averse to the idea of sending his personal info to anyone.

I have all my vital records. Just one problem with my parents' marriage cert. My dad was born with a "II" suffix (ie: John Doe II), but the suffix doesn't appear on the marriage certificate. He wasn't receptive to amending the marriage cert, but was open to signing a "One and the Same" affadavit. Well, I received the prepared affidavit and it has stuff like his birth certificate number and will need to have his driver's license on it. He definitely won't provide that.

Anyone else hit a roadblock like this? I really wish I didn't have to rely on anyone else for this. And my mom won't go against my dad's wishes about amending the marriage cert.

After spending almost a year and a half and thousands of dollars, it's so stressful to run into a roadblock like this so late.

I also was unable to amend a marriage certificate due to some intransigent family members. I wasn't happy about it but what could I do?

Is his name correct on your birth certificate? That might be more important than the missing suffix on his own marriage certificate.

Hi Qualdom,

Luckily this had a good resolution. I asked my ICA case specialist if the driver's license number on the affidavit was truly needed. She said it wasn't and she wrote it out of the document. Now the affidavit looks good to my dad so he will sign and notarize. Thank goodness. When I saw the original affidavit my heart just sank. I truly understand his concerns and I'm so glad my ICA rep was able to be flexible with this.

I was surprised the suffix would be an issue since his place and date of birth are the same on everything. I think my case worker just wants to have all our bases covered just in case.

I hope your discrepancy is only minor and that the judge doesn't mind it.
