1948 Case with Luigi Paiano

Over 25 million Italians have emigrated between 1861 and 1960 with a migration boom between 1871 and 1915 when over 13,5 million emigrants left the country for European and overseas destinations.

Just a thought: I now have my sentenza reference number. Am I right in thinking that while the app can be used to check on case progress, there is no online method to download judgments?

Salve,

Avv. Paiano sends the sentenza via e-mail in a PDF file. The document itself doesn't appear to be downloadable from the pst.giustizia website.

So a couple of developments in my case today:
07/08/2018 - DEPOSITO SENTENZA - PUBBLICAZIONE
07/08/2018 - INVIO ATTI ALL'AGENZIA DELLE ENTRATE

Could this be the date with destiny from which the six month appellate period will run?! Unfortunately my e-mail to Luigi received an out of office message in response so I may still have a wee while to wait to find out - hopefully not too long! :D

Hi! I'm new here.

I decided to enter a 1948 case with Luigi Paiano, and I've been searching for him for abour a month, with no response.

When I call the number listed on his website, nobody answers. His Skype doesn't answer. When I sent him an e-mail, I received an automated answer saying that he is on vacations.

Does anyone here know when he will return?

Thanks in advance.

September. Most Italians are out of work the entire month of August.

I also can't access this link anymore http://pst.giustizia.it/PST/it/pst_2_6_ ... Ricerca=CC
I've downloaded the Giustizia Civile app, but can anyone advice how to check the status there? I've tried a few combinations there but no luck...
Thanks!

By the way, it looks like my husband was granted the Italian citizenship!
It's kind of hard to believe until you get the actual passport in your hands :)))

So I've got a question as Luigi is on holiday...

1. So we have received Comune Servizi Demografici letter and Luigi wrote that we can go with to Consulate...
2. My husband is Brazilian but he lives in London for more than 10y.
Luigi sent this link (IT Consulate in Brazil) https://conssanpaolo.esteri.it/consolat ... /anagrafe/
But I think we need to go Italian consulate here in the UK? I hope we don't need to fly over to Brazil...
https://conslondra.esteri.it/consolato_londra/en/

3. Do we just go and Apply for a passport? Or what's the actual procedure?
Do we need to register for AIRE? Sorry, Luigi didn't really explain much :)

4. What is the procedure of obtaining Italian citizenship for spouses? We've been married for many years and my name is there in the Comune letter saying that we're married/when/where. Can I apply for Italian citizenship as well?

Thank you, this forum is so helpful!

Thanks!
1) click "Uffici" on the app's bottom bar
2) select the applicable region for the location of your court
3a) select which court in that region, probably Tribunale Ordinario
3b) THEN the court's location
4) click Ruolo generale
5) "Numero di ruolo generale" punch in your case number without the year appended
6) select the applicable year

Hope this helps. Easier done than said, but I checked, and these directions find my case.

Has anyone had experience with getting a passport in the Italian Consulate in London?

Also has anyone had experience getting an Italian citizenship for a spouse after being recognised as an Italian?

What does it mean 'all marriages even those that took place abroad must be registered with an Italian Municipality'.
How to do it if the marriage took place abroad (in Brazil)?
(If spouse's name is on the Comune letter that Luigi sent us, does it mean it may have been already registered there?)
Would I need to go to Brazil personally to get it an Apostille on the certificate of marriage?

Delighted to have received an e-mail from Luigi this afternoon with my judgment attached, confirming that on 20 July the Tribunale Civile di Roma granted me Italian citizenship. Finally, the journey that I embarked upon in late summer 2016 with court papers submitted in November 2016 appears to be in the home strait!

I have asked Luigi the question as to whether the appellate period can be shortened to 30 days in my case: at present it is due to expire on 1 March 2019. On the basis that the average time to get Italian birth records is, I am told, 11 months from now, I am keen to expedite this if possible so as to get my passport without delay.

Hi All,

As you said Luigi Paiano is probably on vacation now so I wanted to hear your opinion about my situation.

I'm brazilian, great grand father italian and great grand mother italian too. GGF was born in italy 1879, she was born in 1887.
They both came to Brazil when they were children (under 10yo) and married in Brazil in 1902, they had 3 children my grandfather was born in 1904 in Brazil.

So everyone is man, GGF, GF, F and me and I could do the regular process instead. But there is a big however...

However even though his family records (father mother birth, marriage, of my GGF in one city), I cannot find the birth record of my GGF in the same city. I'm looking for that for the past 6 months and cannot locate there or nearby. Not in the comune, not in Archivio di Stato, etc.

So in that case, if I indeed don't find my GGF birth record, could I use my great grand mother birth cert instead with the 1948 rule? Will the court accept the case with my GGM considering I could do a process with my GGF (if I find the record)?

Truly I think I won't be able to find my GGF birth record and considering there is a line to wait for the consulate in Brazil of 10 years by normal ways (not kidding) I'm considering using my GGM instead with a process in the court.

Other option could be to use the court to accept my case with a missing birth cert of him but I think that is essential.

Waiting to hear back from you!

Regards,

Cesar

Also I read somewhere that you must be resident to go to court, is that true?

Hi Everyone,

I've been in touch with Luigi Paiano and he said I have a case. However, I do not have my great grandparents birth certificates and was wondering if anyone knew of somebody in Italy that I could hire to manage this for me.

Kind regards,

Andrea
