Hi everyone! I’m hoping someone can help clarify something regarding Italian citizenship by descent and the recent law changes!
My father is currently in the process of applying for Italian citizenship jure sanguinis. We are confident that he qualifies and will be recognized as an Italian citizen through a professional service or consulate. His paternal grandparents (who were born in Italy before immigrating to the U.S.) did not naturalize before his father's birth, and all the required documentation appears to be in order.
I was born outside of Italy, and I am a U.S. citizen. I would like to apply for Italian citizenship after my father is recognized.
My question is:
Assuming my father becomes an Italian citizen—either before or after May 27, 2025—will I be able to apply for citizenship through him, regardless of how the new law (Decree-Law No. 36/2025) ends up? I’m concerned about the new requirement that an applicant must have a parent or grandparent born in Italy, which I do not. My great-grandfather was born in Italy, but I was hoping to apply through my father after he becomes a citizen.
Would this still be possible under the new rules, or does the May 2025 law change make that uncertain?

Hi Tony I do not have an answer, I have the same situation however I am just starting the process. Same situation My great grandparents were the immigrants, also never naturalized from all the census logs stating alien. Let's hope the law does not become law or at least keep the generation unlimited

I reached out to ICA, and they told me that under the current law, I would not be able to apply for citizenship even if my Dad was recognized; however, other law firms have indicated slightly differently. I don't know who to believe? All eyes on 5/27/25!!!

Hi Tony, according to the current understanding of Decree-Law No. 36/2025, if you do not have a father or grandfather born in Italy, you may not be eligible to apply for Italian nationality through your father after he is recognized as an Italian citizen, if the recognition takes place after 27 May 2025. However, if your father is recognized as an Italian citizen before that date, you may still have the opportunity to apply as the child of an Italian citizen, under the old law. Therefore, the timing of your father's recognition is very important.
