Question of Italian Citizenship re marriage/divorce

Over 25 million Italians have emigrated between 1861 and 1960 with a migration boom between 1871 and 1915 when over 13,5 million emigrants left the country for European and overseas destinations.

Question of Italian Citizenship re marriage/divorce

Post by oremann2 »

Hello,

I'm currently inquiring about my status as an Italian citizen and wonder if you folks could provide me with some help. I've not been able to find information concerning my situation elsewhere so I thought I should ask before proceeding further,

My father was an Italian citizen who moved to Australia
He married my mother (who was an Australian citizen with no Italian heritage) in 1957
My father naturalized as an Australian and lost his citizenship in 1959
I was born in 1960
My parents divorced before 1983 while I was still a minor.
Both parents continued to live in Australia for the rest of their lives.
I lived with an assortment of paternal and maternal relatives after their divorce.

I suspect the following based off my research:
My mother became an Italian in 1957 when she married my father.
My father lost his citizenship is 1959 when he naturalized but my mother kept hers since she never had any need to naturalize (being already an Australian citizen)
I was born in 1960 and inherited Italian citizenship from my mother.
When my parents divorced (before 1983) my mother lost her Italian citizenship.
After that point. Neither of my parents were Italian citizens anymore.

Am I correct in assuming I gained Italian citizenship from my mother?
If so, did I lose my Italian citizenship when my parents divorced?
Am I an Italian citizen?

Thanks for your time and expertise.

I'm not positive, but I believe that unless your mother actually formally applied for citizenship through marriage, she never actually obtained italian citizenship.

If your mother is still living, she can ask the Italian consulate for a passport. If it's denied, it means she became ineligible to apply for an Italian passport when she divorced her formerly Italian husband prior to 1983. I, in fact know of a similar case. This couple was married before 1983 and divorced before 1983. They have two children and now grand-children who remained in Italy after the divorce. These children are still Italian citizens because their father is still an Italian citizen. The divorced grand-mother visits her family in Italy twice a year but she is not entitled to an Italian passport.
