Hi, I am looking for some answers to help me with my Italian citizenship through Jus Sanguines.
GGF-->GM-->F-->me
GGF, born in Italy, arrives in USA 1904, naturalized 1938
GM, born in USA 1921, (17 when GGF naturalized), gives birth to son 1949
F born 1949
me
I have a company telling me I need a court order to re-establish GM citizenship since she was born before 1948 (in 1921). But I think they may be wrong , as she was born before GGF naturalized? Is a court order necessary?
I saw this in another thread on here "A person born before 01/01/1948 can claim Italian citizenship only from his/her father (who was not a naturalized citizen of another country before his/her child’s birth), and a woman can transfer citizenship only to her children born after 01/01/1948 (if she was not a naturalized citizen of another country before her child’s birth)."
based on that I would think she is automatically an italian citizen, never renounced it, and passed it rightlfully to her son(my father).
dual citizenship question re 1948
Re: dual citizenship question re 1948
You are absolutely correct. Your gm obtained Italian citizenship from her Italian father and passed on to her son, born after 1948. Yours is a straightforward application; no need to reestablish citizenship.
