In my case (which is still in process) not one document was "original". I think the term "original" is confusing, there are copies of the original documents, those were used to obtain certified records. Often those are lost, especially after death and the family splits up possessions and family feuds stop all communication.

Also the "original" birth record in Italy is often in a book at the comune, best you can get is a scan from familysearch.org, visit in person and get a copy or take a picture. I saw these books in person last time I was in Italy at one comune my ancestors came from.

For me:

-Birth and Death, certified copies from the state of PA
-Marriage and Naturalization, certified copies from the County in PA.
-USCIS and NARA search, no records found

Not sure what state you are in, but you don't need "originals" from family either alive or deceased.

In my case I had to get my deceased grandfather and great-grandmother's names corrected because they were misspelled.

Again YMMV depending on where your ancestors settled, but within PA it's quite easy to obtain these records for the most part, the smaller counties mine lived in are not all online, so a phone call or snail mail was the only option. ICA pretty much obtained everything for me or gave me clear instructions on what was needed.

Did you have any discrepancies in the marriage records? If so, what was ICA's attitude towards them?

ICA noted a few corrections that were made to my parent's marriage cert. due to some spelling variations, but nothing concerning my grandparents and great-grandparents, the names were spelled correctly believe or not.

This is the conflicting issues, people say the state wont apostille a original, yet you're saying you did.


I am not sure why people are saying that. They MUST go to the Secretary of State of the state the document is issued.

Maybe the issue here is definitions:

Original document is a freshly issued document of the contents of the record book. This is also called Copy of Record. Either way, the document needs to be recently issued and it needs to be Certified by the issuing agency. So, call it what you want. Just make sure is not a Xerox copy someone in the family sent via email. That will definitely not get anywhere.

The trial was on December 7th and I was notified on the positive result on December 30th. I was told that the appellate period was 90 business days, which is different from other cases on this forum, which were 1 month or 6 months. The 90 days period ended yesterday, but I was told by my lawyer that "due to the pandemic, the judicial bureaucratic procedures are still delayed".

Has anyone had their appellate period end lately? So I can know more or less of how much delay to expect.

I'm sorry that I don't have an answer to previously posted questions, I just wanted to update my timeline:
2021-09-14 - Non-appellation certificate signed.
2021-10-01 - Non-appellation certificate forwared to me by my lawyer.
2022-01-14 - Commune certifies my inscription with the "Acta di nascita" and is forwarded to me the same day by my lawyer.
2022-01-14 - Also on the same day I send my documents for AIRE registration through Fast-It, according to instructions.
2022-02-14 - AIRE application is rejected with the message "VERIFICA FALLITA. SI SARA' GRATO DI RIFARE LA PRATTICA." (No further information was included).
2022-02-25 - I give a phone call to the consulate (Santiago, Chile) and they tell me to forward all the documents via email.
2022-02-28 - I send all the documents via email to the consulate

I'm still waiting to hear back and see what I did wrong :/

Another successful case, this were my last steps:
2022-03-18 - The consulate tells me that i'm still not registered on AIRE, I send the documents again via email as Fast-it is not letting me start a new application.
2022-04-08 - The consulate confirms that I'm registered on AIRE
2022-04-11 - Unsuccessful attempt to book an appointment via Prenota-Mi, at my consulate they only open new slots every Monday at 12:00
2022-04-18 - Another unsuccessful attempt, the slots were gone by 12:01
2022-04-25 - I couldn't even load the Prenota-Mi website this Monday
2022-04-26 - I check again this Tuesday at 9:00 and I'm surprised that they have available slots! Probably the website crashed on Monday and nobody could make reservations. I make a reservation for May 9th.
2022-05-09 - Passport appointment at the consulate, everything goes as planned, I'm told that the passport will be ready to pick up next Monday
2022-05-16 - I picked up my passport :o all the years waiting were worth it!!!

I obtained my Italian Citizenship over a year ago. I am now interested in applying for an Italian Passport. I did some research and please correct me if i am wrong... Do I need to live in Italy for a certain amount of time before i can apply for a passport?

If my current and permanent address is in the USA do I qualify or am I disqualified from obtaining an Italian Passport?

No you do not need to live in Italy for a period of time, you just go to your nearest consulate and make an appointment or schedule it online, have the interview and also make sure you are registered with AIRE prior.

After 20 years working on this project, I have received word from Luigi Paiano indicating the Court has recognized our Italian citizenship. I couldn't be happier. Paiano sent me an email with the court order. See my timeline below (we got stuck with changes of judices and also the COVID. Does anyone know what happens next after the "INVIO ATTI ALL'AGENZIA DELLE ENTRATE" entry? The actions/entries on my case look very different than others have posted in this forum. I can't tell what is left for the Court to do.

We had two cases because we are so many in the family. Case A is the first it am listing here. Case B needs an amendment. See below.

I've finally put together what I hope is all the documents for our 1948 case with Luigi Paiano and I'm eager to get the actual process started, but Luigi hasn't answered my last two mails. He was quick to respond before and I have no doubts his studio is the way to go, but now that I've sent copies of all documents for him to check before translation and apostille, the wait is stretching longer than we thought (and after having read some of the comments on this forum, I'm hoping it's not that he thinks it's a hard case to win!). Has anything like this ever happened to you? Could it be his holidays (without automatic replies to mails)? Would you recommend contactimg him by phone? We've read glowing reviews and two people recommended him to me, but I'm at a loss as to why he's not replying my mails.
