How to obtain birth and marriage from New York?
Re: How to obtain birth and marriage from New York?
VitalCheck too expensive for NYC. Better to request directly.
Re: How to obtain birth and marriage from New York?
What can I give them when they are asking for the documentation establishing a judicial or propose purpose?

Do I need letters of exemplification for all my birth certificates for 1948 case? They didn't send me one when I requested mine.mler wrote: 26 Nov 2021, 20:59 Unlike NYS, getting those documents from NYC is not too difficult. Avoid VitalCheck and go directly to the NYC Department of Health

If you look through the FAQ, you will find instructions for obtaining birth certificates for deceased relatives, and children and grandchildren are eligible to obtain them.
When ordering the birth record, request a certified Letter of Exemplification. Submit both to the County Clerk in Manhattan ($3). This can be done by mail. Then send certified document to Albany for apostille ($10)
You should make a copy of the certificate to send to the translator while the original is out for apostille. Once I had the certificates, I was able to obtain the apostille within two weeks. However, this was before COVID.
Re: How to obtain birth and marriage from New York?
The New York County Clerk won't authenticate the birth certificate without the letter of exemplification. And without the County Clerk's authentication, you can't get an apostille from New York Department of State.lucaless wrote: 17 Mar 2022, 17:39 Do I need letters of exemplification for all my birth certificates for 1948 case? Do you have an example of what they should look like? Thank you.qualdom wrote: 17 Mar 2022, 23:01The New York County Clerk won't authenticate the birth certificate without the letter of exemplification. Thanks for that, he stated it is a different story for new york state certificates which mine is. Seems from that video letter of exemplification only apply to new york city. Do you know more about this?
Re: How to obtain birth and marriage from New York?
Exemplification not required for NYS, only for NYC.
Re: How to obtain birth and marriage from New York?
The reason for this is that usually a document must have been certified by a county official in order to be eligible for an apostille. In all other counties in New York, a birth certificate is certified by a county official so it is ready for an apostille.lucaless wrote: 29 Mar 2022, 23:47Thanks for that, he stated it is a different story for new york state certificates which mine is. In NYC, you have the distinction between the boroughs and the counties, even though they are coextensive. So birth certificates are issued by the New York City Department of Health and Mental Hygiene. A letter of exemplification is the current city registrar confirming that the certified is a true copy of the original record.
Since New York State doesn't have the signatures of NYC officials on file, it needs to be taken to the New York County clerk who verifies the signature on the Letter of Exemplification.
So basically, the situation is that the New York State Department of State is validating the signature of the New York County Clerk, who validated the signature of the NYC City Registrar, who validated the copy of the birth certificate.
Re: How to obtain birth and marriage from New York?
Thanks for the explanation. So no letter of exemplification is needed for NYS? The certified copy that they sent me is suffice?qualdom wrote: 02 Apr 2022, 16:36The reason for this is that usually a document must have been certified by a county official in order to be eligible for an apostille. That helps thank you.
Re: How to obtain birth and marriage from New York?
Anybody know a timeframe on getting these? It's been over a month since I requested marriage and birth and haven't heard back. I assume NYC has more of delay than NYS.
Re: How to obtain birth and marriage from New York?
I ordered a marriage certificate recently from NYC and I think it took about 5-6 weeks.
I don't know about the timeframe for NYC birth certificates. Prior to Covid, I would always walk in and I would have a birth certificate in less than 20 minutes.

Birth certificates seems to be the ones that take longest, still waiting on those.
Re: How to obtain birth and marriage from New York?
How do you recommend getting the apostilles? Should I send all at once or have it done separately? I have all the certificates, just waiting on the USCIS paperwork.mler wrote: 26 Nov 2021, 20:59 Unlike NYS, getting those documents from NYC is not too difficult.
