1912 "Rule": Is there no hope?

In the process of gathering documents, I've found that my GGF is listed 'Na' on the 1910 census. I had submitted some requests for searches to NARA, hoping to find that GGF naturalized after GF was born (still waiting). And then I found out about the 1912 "Rule"...

I can only pray that all searches show "No Records Found". Other than that, is there any hope? Any way to challenge this?

BTW, I fall under the Chicago consulate's jurisdiction...

Pray for the "no record found," which is quite possible since census records were notoriously inaccurate. As far as I know, there's no getting around that interpretation of the 1912 law.

May I also suggest that you ask the kind people here to help you do a search of your ggfather's records. If you provide some names and dates, perhaps someone can find more than just an old census record.

Thank you mler! I did exactly that in the "Genealogy" forum, and found out to a very high degree of confidence that my GGF was born in the San Gennaro hamlet of Cappannori, Lucca Province!

Nothing yet. I've sent requests to National Archives, and am waiting on their response. Are there those here who have access to that kind of information, from other sources?

Yes, I was waiting for mid-August to use the new USCIS Genealogy Program!

Also, did you mean that GGF Angelo declared as Alien in 1900 census and NA in 1910 census? That would be awesome (GF born in 1901), if it weren't for that darn 1912 thing. Here's to hoping the 1910 census is wrong!!

I spent a bit of time in the library yesterday (they have free access to ancestry.com) but was unable to find a 1900 census record for GGF Angelo... Can I ask please where you found it?

Ahh! I skipped that because of the spelling! But it can be clearly seen to be "Sodini" rather than "Sodine"!

I am happy to report that NARA has replied with "no records found"! Now just waiting for the new USCIS Genealogy Program to go on line. But, I'm sufficiently enough encouraged to go ahead and schedule an appointment with the Chicago consulate, send off for GGF/M's Italian Birth/Marriage records, etc..

Sorry for the late reply, but I don't check in very often.

In my case, the "1912 Rule" turned out to be irrelevant. My GGF naturalized via the Superior Court of Cook County in 1897...
