Delayed Birth Certificate State of New Jersey

Has anyone had to file a delayed birth certificate with the state registrars?

I hope this is the correct form as I am applying for dual citizenship.

this would be for my grandmother born 1908 (here is the direct line through which I am applying: me-->mother born 1/5/48-->grandmother--> great grandfather). The helpful women at the state registrars office told me I would need a court order to file a delayed birth certificate since my grandmother is deceased.

I suppose it was common, especially for immigrant famiilies, to not file a birth certificate in municipalities.

I am gathering supporting documents to build my case:

certfied passport application, certfied census (1910), baptismal record (which I am under the assumption she used to apply for her US passport), death and marriage certificates. can anyone think of any other documents?

Also does anyone know about the county courts in NJ? How to go about getting a court order for a case like this. I will not be hiring an attorney unless I absolutely need one. I like the challenge. I would go through the Bergen County Superior court in Hackensack NJ.

It was also common for names to be so grossly misspelled that the document is impossible to find using normal search criteria.

My mother, the youngest child in her family and the only one born in a hospital (three eldest siblings born in Italy, five others born at home in NY), has a totally screwed up NY birth record. Firstly, her parents had not yet chosen a name, so the BC says simply "Unnamed female child". In addition, her father's name is grossly misspelled (four out of 8 letters are incorrect!) and her mother's also misspelled (but less so).

The only reason we have the document at all is that my mother needed it when she married and, way back then in the 1940's, they were able to locate the record based on her date and location of birth.

The nice women at the NJ state archives did a search for me under variant spelling names and reported to me there is no child born on march 7th 1908.

so..... I am fairly certain there was no record of her birth.

I will know for sure when I get the passport application back from the state department. It will state what evidence she used to prove her identity.

I don't know where in NJ, she was born, but the midwives did not file the paperwork every day. Often a group of babies were all registered on the same day. My father was born at least a week before his "official birthdate." I would check a week or so after the actual birthdate. Also they were not necessarily too quick to baptize. Baptism dates could be well after the birth date.

I would also check at the city or town level. They have the original documents, and the City of Newark, for example, charges less than the state for documents.

I have already checked with the town. It is a bit complicated because the town where my grandmother was born was not incorporated until 1916 and she was born in 1908.

As per us census she was living in Harrington Township in 1908, Northvale was a part of harrington township ...

Now some of the records ended up in Harrington Park. The town clerk will be checking the vaults for me there as well... and then there are other towns like rockleigh in the area.... like I said it is a bit complicated.

for now I am going to sit tight and wait for the state department to get back to me with the passport application.

my moms birth record is not found in the birth index. I was able to find her bapstimal certificate but the church claims that the place of birth was not stated. However when she married Italy se presented her baptismal certificate and they wrote nevy jork....very likely because they saw N.J. and they took no geography history lessons to distinguish that NJ stands for new jersey. A draft card from my grandparents indicates his actual nj address 3 months prior to my moms birth...will this work? In addition ellis island records are available as proof stating the years that my grandparent was a us resident and the years cover where my mom was born.

What is required to file a delayed birth certificate?

In order to request a delayed report of birth, you must first file an application requesting the birth certificate to ensure the record is not on file. If no record is found, you will receive a No Record statement, which must be returned with a letter of request to place a delayed report of birth on file. You will receive a questionnaire to complete so that a more detailed search can be completed. You will also need to provide documentary proof that the birth took place. Documentary proof will be reviewed and a determination made. Please contact the Record Modification unit toll-free at 1-866-649-8726 extension 581 for further information.

I won my case and the judge is going to sign a court order so I can get a delayed filing of my grandmother's birth certificate.
