He was born in 1819 so the death cert is used to show he was alive during the countries unification in 1861.

Hey guys,

I'm a bit confused in our case. We sent all our documents to Luigi in February'16.
He said that the hearing will happen in September/October '16.
I saw that people here saying that they get exact dates of their hearings and got their Judges appointed? Why we didn't yet? Or I got it all wrong?

He wrote this today:

I've started my case with Luigi in February.
Did you get your hearing dates & Judges appointed straight away?
It's already May and we don't yet have exact date, just an approximate..

After almost a full year since my first audience was set, i can now declare success!

My birth certificate, along with the sentenza, has been transcribed. Going through the Anagrafe (and a close friend of the family who worked in the Comune di San Giovanni Teatino until his retirement last year) in San Giovanni Teatino, I've sent over all of my documents via e-mail.

I'm establishing residence, using an Autorizzazione di Residenza and a Comunicazione di Ospitalità from my cousin, the apartment owner. My contact at the Comune saw that they would transcribe everything (including my wife’s details) even though I’ve only sent all the documents digitally.

I’ll go there next week to bring the originals to all the documents.

Once I have the Carta d'Identità and Passport I’ll be ready to return to Barcelona and register in AiRE whenever (no rush).

@zamanka Luigi should have sent you the case number. If not, I'm sure you could ask unless it's still waiting to be assigned a judge then maybe you don't have one yet. Here is the website to check the status of your case:

Make sure the region is Lazio and the "Uffici Giudiziari" is "Tribunale Ordinario - Roma" and "Contenzioso Civile" for Registro. After that, click "Ruolo generale" and fill in your case number and year. Your case should pop up on the following screen if it's in the system. Click on the case and all the details should appear.

Luigi usually gives exact dates when he knows them and a general timeline when the date is uncertain (he gives a ballpark figure based off his previous cases but is pretty conservative with them), so your case may not have been assigned to a judge yet. I'm in the middle of my case which has taken almost two years. Had the first hearing postponed and then my judge always requires a second hearing. Now I'm waiting for the decision to be published. How fast your case goes depends on the judge and their workload. Some people are done in under a year, others like me aren't so lucky. Then there's the appeal period and registering time after the decision.

Greetings from San Giovanni Teatino.

Just got my Carta d'Identità yesterday, plus my Certificato di Cittadinanza and my Estratto per Riassunto di Atto di Nascità. All thanks to the fact that the Sentenza actually declares me a cittadino italiano, allowing me to skip a large part of the residenza process people have to follow when they come to Italy to be acknowledged.

Next steps, codice fiscale (already set, now I need the tessera), tessera sanitaria, and passaporto.

Thanks you so much for your reply @dojo, you cleared all my questions really.
I was reading on the forum that people got their judges assigned within a month or so. And I was a bit confused why our's is different.
And I was able to check about our case (thanks to your detailed description how to do it) and that's what I've got. So I guess we're waiting for a judge to be appointed now.

Hi all!

Long time reader, first time poster! I have been trying to gain dual citizenship for myself and my mother/brothers for over a decade, and since my mother was born in 1946, every embassy/consulate member/person in the world has told us there's really no hope for us. I know we still have a long, long way to go, but I just thought I'd post and say that the other day I jumped aboard the Luigi-Paiano-1948 train, and finally contacted Luigi Paiano (due in no small part to the great information and 'reviews' I found here)! I also heard back from him today, and he said it sounds like our case is the kind he typically takes on. It has been so encouraging to read your posts, and I just hope that we will have the same success many of you have had!

I do have one question...I realize some people have mentioned this, but I'm curious about those of you who have had to deal with ancestors naturalizing in the US, etc. Essentially, my mother was born in the US in 1946, and both of her parents were born in Italy. I know my grandfather naturalized a few years before she was born, but we can't find any record of my grandmother ever naturalizing, though we continue to search just in case (she used a number of different names, so now we're sorting through these). Has anyone had to deal with getting that report that basically says, "no record of naturalization"? Seems like those would take a while to generate? And also, if we do uncover a record of of my grandmother naturalizing before the birth of my mother, do you think this mean our chances are kaput?

Any thoughts would be so appreciated, but either way, I'm so happy to be here and to read all of your posts!

You have to request a "No Record of Naturalization" from USCIS (and/or NARA too, I think, if the naturalization would have occurred in a certain set of years) You have to provide her maiden name and aliases. It takes several months to get the info back unfortunately, I'm not sure if they have an expedited process. It usually takes 5-6 months. As far as chances go if your grandmother naturalized, it would depend how she naturalized (marriage or elective) and when. If that were the case, the best response would be from Luigi himself. To challenge the 1948 case in Italy do you have to get your paperwork approved through an Italian Consulate here in the United States first?

@lvelt No you don't go through the consulate at all for this process (Unless you requested a family member's document from them for some reason). However, you need to have documents affixed with an apostille from the state where they were issued, i.e. birth certificates, marriage certificates, etc... need an apostille before sending them to Luigi.
