Question about eligibility for Italian citizenship by descent

Over 25 million Italians have emigrated between 1861 and 1960 with a migration boom between 1871 and 1915 when over 13,5 million emigrants left the country for European and overseas destinations.

Question about eligibility for Italian citizenship by descent

Post by TideFighter »

Hi, everyone!

I've read so many stories here just looking around, and gathered lots of helpful information. I'm hoping someone might be able to look at the general details of my situation and know whether or not myself and my wife/children might be eligible.

Great-Grandfather
Born in 1902 in Reggio di Calabria
Came to US (NY) w/his father & brother in 1911

Grandmother
Born in 1934 (US, NY)
Her mother was born in 1897 in Genoa, married my GGF after they both came to the US

Father
Born in 1960 (US, AL)

Me
Born in 1985 (US, FL)

Any knowledge from experience would be most appreciated. Thanks!

Very shortly, the main issues are
You need to know it your GGF naturalized before your GM was born.
If he wasn't, you have a chance to get your citizenship through a 1948 court case.
Giuseppe "Pippo" Moccaldi

Certificate requests and genealogical researches in Italy.
Translation of your (old) documents and letters.
Legal assistance in Italy for your Italian citizenship.

Also, since your ggf was a minor when he arrived, you will need to check if his father (your gggf) naturalized while he was still in his minority.

Why a 1948 case?
If the grand-mother had not lost Italian citizenship before, she gave citizenship to her son born in 1960.

Not a 1948 case. It goes through the paternal line until after 1948.

The gm was born to an Italian man in 1934. She had her child after 1948.

The only possible issue is if the ggf naturalized as a minor or as an adult before gm was born.

Best I can tell, based on a 1920 census document from Ancestry, my GGF naturalized (along with the rest of his family) in 1917 (he would have been 14 or 15).

The naturalization of your ggf during his minority (derivative naturalization) eliminates the possibility of applying through his line. Did your ggm naturalize?

Might you have a possibility through your mother’s line?
