Yes, I tried to get his certificate from NYC which is how we got the "No Record Found" document. However, the consulate is pretty explicit that they need a long form birth certificate.
I suppose contacting a lawyer may have to be my next move

This is anecdotal; on my father's side my 2nd great-grandfather from Naples married a Sicilian woman. On my mother's side, my great-grandfather from Bari married a woman from Naples. Both marriages occurred in the US, so I wouldn't say it's rare.

Hi Edward, these records are from Palermo it seems. Retrieving records from there was relatively easy. Do you know anything for Napoli? The Antenati site does not have records from there during that period.

From what I have read, there are many gaps in the civil records for Napoli between 1865 and 1900. Has anyone had any success getting documents from this period? I'm looking for a birth certificate from 1877 but I'm starting to lose hope.
