WORST NEWS POSSIBLE!
so the registrar has now told my researcher that MY GGF certificate is 100% not in the commune. I know he was born there and it has been destroyed. what can I do? baptismal certificates are not available for him. I am about to cry
what can be done someone please. on top of that he left before the military would have had a record for him.

I would not yet give up hope on the military records; it is possible that one exists, even if it is simply to identify him as a deserter (because he did not report for duty when he came of age). Did you write to the provinical archives to request military records yet?
Also, I am told that passports came into general usage in Italy beginning around 1900. While passport records are not in themselves open to the public, I wonder if a request could be made regarding whether the passport records survived the war and, if so, could they be searched in order to provide documentation for the re-creation of a lost birth record.
These records would be held either by the state police office (the "Questura") in Napoli ( http://questure.poliziadistato.it/Napoli ) or in the provincial archives (the contact information in another of your threads).

I ordered the military record in an email the minute you told me to. and that is a good idea but what would I write to them and how would i get them to release the record? also who can I contact to write me a letter in Italian to ask this? of course I am willing to pay. and carmine you once again are helping me and keeping me Hopeful when I am in doubt ! thank you !

I ordered and rec'd online what appears to be my GGF's military registration from Cosenza's web site. It showed he was in America at the time. When I sent the fee they wanted for it I told them that Altomonte the commune I was trying to get his birth certificate from doesn't respond and did they have a copy of his birth certificate. They sent me what appears to be his birth record. I am not sure it's what they need at the consult but the point is they are like the equal of our states and the town he was born in [Altomonte] should also have his record. It should be in both places from everything I have read and it in fact appears to be. Did you check with both the state and the city. I also just found a copy and picture of the book and the registration # of his birth looking on Mormon microfilm. I did that so I could tell Altomonte exactly where to look.

The commune is where I checked I hired a service . He never registered for military because he left before coming of age . Where do I write to on the state level for Napoli ?

-by military record in Archive of State- in the province where your ancestor was born- the Archive Director can relay a certificate stating abt the your ancestor birth by military record in the Archive ( maybe need of apostille also);
the Archive Director certificate can be helpful in place of birth certificate for obtain the dual citizenship...
for more details and for to be sure it is better that you contact the italian consulate asking abt that, and also you must to explain ( by reply of Commune) that the birth registry was destroyed...

yes, suanj is right, if the record is destroyed, there should be a copy at State Archive or at Court house.
At least the comune can request a photocopy of it, with seal of "true copy" and seal of court house, it needs to be apostilled, and it is useful for you citizenship application

Ah I see how would I contact the state archive or courthouse for city of Napoli ? Thanks for giving me some hope back!

if not, About court house you need to tell your researcher to talk with the registrar, because he is the only one who can request that kind of document from court house.

My great grand father wad born 1887 and left when he was 17 or 16 . Would all this still apply?

ok, I know that Archivio di Stato di Napoli has the 2nd copy of civil records up to 1865.
The 2nd copy from 1865 to today is at court house.
So if the civil record office of the town where he was born, has not it anymore, the registrar of that municipality must request the copy to court house, on your behalf. Tell this to your researcher.
Also you can always try with the parish, in order to have a bapt certificate with name of his parents on it

Also check with Archivio di Stato di Napoli about your ancestor military draft card, at least you have a document as a strting point

I find it odd that the researchers dis not offer to check court houses . Not even mention it. Are my chances good?
