Citizenship through grandfather when father already had his right recognized

Over 25 million Italians have emigrated between 1861 and 1960 with a migration boom between 1871 and 1915 when over 13,5 million emigrants left the country for European and overseas destinations.

Citizenship through grandfather when father already had his right recognized

Post by eriksteves »

Hi everyone!

I am desperately confused and hoping someone has encountered a similar situation or can provide some insight.
I am located in Toronto Canada, where I have lived for nearly 10 years, but was born in Brazil.

My great-grandfather was born in Italy in the province of Udine back when the Austro-Hungarian empire existed.
His citizenship is technically Austrian, but due to the fact the area now belongs to Italy, we are entitled to Italian Citizenship by blood through him. His name and spoken language were also Italian. He immigrated to Brazil as a child but never naturalized as a Brazilian.

Back in 2009 my father, brother and I started the process of recognition of our citizenship (in Brazil).
We had established that we were eligible as per the following reasoning:

1. Great Grandfather was italian and never naturalized Brazilian >
2. My Grandmother was brazilian born, before 1948 >
3. My father was Brazilian born in 1958

In 2010, about a year after we had applied, the Consulate in Sao Paulo (Brazil) called us to "officially sign our applications". At that occasion, I had already moved to Canada and was not able to do that and so the consulate advised my dad that I could start a new application here in the future.

Fast forward to 2017, after many years waiting, both my father and brother got their Italian Citizenships recognized. They are registered in the comune in Italy (Ruda, in Udine) and have their Italian passports. My dad has already gone to Italy a few times since the recognition.

My question is:
There seems to be abslutely no consensus as to whether I, to apply in Canada now in 2018, need to submit all documents, all the way back to great-grandfather all over again, OR, if now, given that both my father and brother have had their citizenship recognized by Italy, I should only present their information and therefore, apply as "the son of an Italian citizen".

Any help with this tricky situation will be greatly appreciated.
I have tried the consulate in Toronto, where I live, but they have been way too busy to advise me.

Thanks again.

It seems that in most cases, at least in the US, you need to provide all the documents to the consulate unless your family’s documents are already on file there. Since your father applied in Brazil, the consulate in Toronto would not have the relevant paperwork.

It may be possible to avoid this if you apply in Italy at the comune at which your family is registered. You may want to contact them for guidance.
